The agreement announced in 2023

On 21 November 2023, the US Department of Justice announced that Binance had pleaded guilty to violations relating to the Bank Secrecy Act, registration as a money transmitting business and sanctions rules. The total financial penalty under the agreement was approximately $4.316 billion.

According to the department, this included roughly $2.511 billion in forfeiture and a $1.805 billion fine. The widely reported $4.3 billion figure rounds this combined amount.

Why were controls central to the case?

The department’s announcement focused on shortcomings in customer identification, transaction monitoring and suspicious activity reporting. The case concerns the company’s failures and admitted violations; it does not establish that every transaction on the platform involved criminal proceeds.

Beyond the payment

The 2023 agreement also included an independent compliance monitor and commitments to improve anti-money laundering and sanctions programmes. This report describes the terms as announced at the time; it does not assess their implementation today.
