The tender eligibility condition

One of SICPA’s disputes in Kenya concerned a challenge to KEBS tender conditions. The appellate decision dated 2 August 2024 addressed the company’s objection to an eligibility requirement. The Ledgers archive records this stage as a rejection of that challenge.

What does an extension of time mean?

The Supreme Court decision of 14 March 2025 concerned the time allowed to file an application. Granting the company additional time does not mean the tender condition was ruled unlawful or that the company won the underlying dispute.

To describe a procedural ruling accurately, it is necessary to identify the particular request the court decided. The case title or names of the parties alone are not enough.

Keep separate contracts separate

The KEBS tender, the Kenya Revenue Authority’s KRA excise stamp contract and fuel marking work are separate matters. A development in one should not be presented as the outcome of another. This report focuses solely on the chronology of the specified KEBS decisions.
